重庆市国土资源和房屋管理局是主管全市土地、地质矿产、房屋和住房制度改革工作的市政府组成部门。主要职责是：

（1）贯彻执行国家颁发的有关土地、矿产资源、房屋和住房制度改革的法律、法规、规章和政策：起草土地、矿产资源、房屋和住房制度改革方面的地方性法规议案和政府规章以及相关政策并组织实施。

（2）起草住房制度改革和土地使用制度改革方案以及有关政策草案，并组织实施。

（3）负责全市城乡土地、房屋权属确认和登记发证的统一管理。

（4）统一管理全市城乡土地、矿产资源。编制并组织实施土地利用总体规划、年度用地计划和基本农田保护规划；负责占用基本农田的审查报批，负责土地用途管制工作；组织和指导土地开发复垦，耕地保护和土地开发整理工作，负责土地资源调查、监测、评价管理。组织矿产资源的调查评价，编制并组织实施矿产资源保护和合理利用规划、地质灾害防治和地质遗迹保护规划。

（5）统一管理全市建设用地的征用、划拨工作；负责土地征用、划拨的审查、报批；负责全市土地整治开发的管理工作。

（6）统一管理全市土地、公房资产；负责土地使用权出让、出租、转让等有偿使用的管理；负责农村集体土地流转的管理；负责企业改制中土地使用权的处置，负责外资企业用地的管理；负责对市有公房的资产管理；负责对授权的其他国有资产的管理。

（7）依法管理矿产资源的探矿权、采矿权的审批登记发证和转让审批登记；承担矿产资源储量管理，地质资料的汇交管理；依法实施地质勘察行业的管理，审查地质勘察单位的资格，管理地勘成果；审定探矿权、采矿权评估机构资格，确认探矿权、采矿权的评估结果。

（8）组织监测、防治地质灾害，保护地质遗迹；依法管理水文地质、工程地质、环境地质勘察和评估工作；监督、监测防止地下水的过量开采和污染，保护地质环境；确定具有重要价值的古生物化石产地、标准地质剖面等地质痕迹保护区。

（9）负责全市土地、房屋定级估价及地价评估的确认，负责房地产转让、租赁、抵押、典当管理和房屋权转让等房地产市场管理，负责房地产中介服务机构和服务人员的资质管理。

（10）负责全市住房解危解困、廉租房、集资合作建房工作的规划、计划、协调、组织实施和监督。负责全市物业管理，审批物业管理企业资质，指导和监督物业管理工作。

（11）负责全市各类房屋的使用、装修安全、修缮、白蚁防治和拆迁的行政管理。

（12）负责全市土地出让金和收益金的核收、征收、解交；负责房改资金的归集、管理；负责房管资金的核收、征收和管理。负责矿产资源补偿费、探矿权、采矿权价款和使用费的征收和管理；安排国拨地勘费并对使用情况进行监督。

（13）依照<<重庆市测绘管理条例的规定>>负责全市地籍，房籍测绘的管理。编制并组织实施地籍、房籍测绘规划，管理地籍、房籍机构资质，管理测绘成果的档案。

（14）组织开展对全市土地、地质矿产、房屋执法情况的执法监察，依法对各种违法违章行为进行行政处罚，裁决权属纠纷；负责土地、矿产资源、房屋的行政复议和行政诉讼。

（15）负责全市土地、地质矿产、房屋管理和房改的科技、信息、档案、综合统计；负责外事、宣传及职工培训的组织指导。

（16）指导区、县（自治县、市）土地、矿产资源、房屋和房改工作。

（17）承办市委市政府交办的其他事项。
