一、机构
天津市国土资源和房屋管理局是主管全市土地资源、矿产资源、海洋资源等自然资源的规划、管理、保护和合理利用,以及房地产行政管理、住房保障和改革工作的市政府组成部门。
二、职能
(一)贯彻国家和本市有关土地资源、矿产资源、海洋资源(海洋渔业资源除外,下同)、房地产、住房保障和改革方面的法律、法规、规章和政策;研究拟定有关地方性法规、规章和政策;制订相关技术标准、规程、规范、定额和办法,组织实施并监督检查。
(二)组织编制和实施全市土地利用总体规划,基本农田保护区规划,国土开发、整治、保护规划;会同有关部门编制和实施房地产业及住宅发展规划;组织矿产资源和海洋资源的调查评价;编制和实施矿产资源和海洋资源保护与合理利用规划、地质勘查规划、地质灾害防治和地质遗迹保护规划。
(三)贯彻实施耕地特殊保护和鼓励耕地开发政策,实施农用地用途管制,组织基本农田保护;负责未利用土地开发,土地开垦、整理、复垦和滩塗的开发利用管理;负责农用地转用、征收等有关工作;组织编制土地利用、储备、供应计划,落实国家下达的年度用地控制指标,确保耕地总量动态平衡;承担市土地资产管理委员会的日常工作。
(四)负责土地确权登记发证和房屋所有权登记发证工作;负责国土资源测绘和地籍、房籍的测量管理工作;负责地籍和房屋权属登记资料的管理;负责涉外房地产和代管房地产的管理。
(五)负责全市各类建设项目的用地管理;负责城镇建设用地规模的总量控制、用途管制;负责各类建设用地的供应,建设用地预审,核发建设用地批准书和国有土地划拨决定书。
(六)研究拟定深化土地使用制度改革的政策措施,并组织实施;负责国有土地使用权的出让、转让、租赁、抵押、土地资产处置及政府收购、储备的管理;负责土地定级估价和价格管理,公布基准地价;负责土地评估价格确认和土地评估机构资质管理,制定土地使用租费标准;负责农村集体非农土地使用权的流转管理。
(七)负责房地产市场管理;负责商品房销售、房地产交易、经营、抵押、担保、典当和房屋租赁、置换、交换、经纪、信息管理;负责房地产评估、拍卖和房地产价格评估机构的资质管理;负责房地产有形市场的监督管理。
(八)研究拟定深化住房制度改革和完善住房保障制度的政策措施,并组织实施;负责住房货币分配制度改革、公有住房出售、公有房屋租金调整工作;承担市住房委员会、市住房公积金管理委员会的日常工作。
(九)负责物业管理的行业管理;负责物业管理企业的资质管理;指导、协调、监督业主委员会的活动;负责房屋共用部位、共用设施设备维修基金归集和使用的管理;承担市物业管理领导小组的日常工作。
(十)负责各类房屋的使用、修缮、改造、拆除和安全鉴定的行政管理;负责国有土地和集体土地房屋拆迁管理工作;组织房屋普查工作。
(十一)负责历史风貌建筑和历史风貌建筑区的保护利用、腾迁整理、综合整修、装饰装修和改变用途的管理;承担市历史风貌建筑保护委员会的日常工作。
(十二)负责对矿产资源的开发、利用和保护进行监督管理;负责矿产资源储量及其探矿权、采矿权的管理;负责矿泉水、地热资源开采的管理;负责全市地质勘查行业管理;负责地质勘查单位的资质管理;负责地质资料汇交、保管、利用的监督管理。
(十三)负责地质环境及地质灾害的调查、评价和监测;负责建设用地的地质灾害危险性评估的备案和评估单位的资质管理;负责地质灾害治理工程勘查、设计、施工、监理单位的资质管理;指导地下水动态监测、评估和预报;依法管理水文地质、工程地质、环境地质勘查和评价工作;负责矿泉水注册登记工作和组织矿泉水评审鉴定工作;负责具有重要价值的地质遗迹的认定、保护管理。
(十四)管理地热资源的勘查、开发、利用和保护;编制地热资源开发、利用规划;负责地热资源的开发项目、保护方案的审批。
(十五)组织指导并监督国土资源、房地产、住房保障和改革的行政执法工作;依法查处重大违法案件和各类违规行为;负责有关行政复议和行政诉讼应诉工作。
(十六)负责国土资源、房地产、住房保障和改革的统计分析,按规定发布相关信息;负责本系统科技、教育和信息化建设工作,编制科技进步和人才培养规划;负责有关执业资格的管理工作。
(十七)负责全市直管公有房屋的资产管理;负责局属单位国有资产的监督管理;负责国土资源和各类房地产行政事业性收费管理;负责住房保障和房改资金的管理。
(十八)领导各区县(含开发区、保税区、新技术产业园区)国土资源管理部门、房地产行政管理部门和房改部门的业务工作。
(十九)承办市委、市政府交办的其他事项。
